Filing an Income Tax Objection

According to the Income Tax Act, the objection procedure is admissible in Quebec and Canada for any individual or corporation that pays taxes. If you disagree with your notice of assessment or determination, you can request a new examination of your GST-QST or income tax return. This objection can be made to Revenue Canada, Revenu Québec, or both. You can then discuss your file with a government auditor and correct any errors. 

To assert your right to tax dispute, and possibly appeal, you must file an objection within the specified time limit. You have 90 days to file an objection after receiving the notice of tax assessment. Note that this can be a lengthy process! Sometimes the government will acknowledge receipt 6 months to a year after it is sent. In the meantime, interest and penalties continue to accumulate on the amount owed. It is therefore advisable to pay the amount of your taxes owed while waiting for the decision. As for taxes, you are required to pay them even if there is an objection.

If you disagree with your notice of assessment or determination, the first step is to contact the person responsible for your notice. This step will help clarify the situation and help you decide whether it is necessary to initiate an income tax objection process.

First, make sure you gather together the necessary documents to prepare your case. This will save you time in the process, and you will be ready to respond to the auditors’ requests. Once the Canada Revenue Agency (CRA) or Revenu Québec has made a decision, it is final. However, you may appeal to the Court of Quebec or the Tax Court of Canada. You have 90 days to appeal the decision on your Notice of Objection.
